PRIVACY POLICY

1. Scope and Overview

BoardWalk Consulting LLC ("BoardWalk," "we," "us," or "our") is an executive search and consulting firm. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information through our websites, online services, recruiting and candidate activities, client engagements, marketing, events, business communications, and other interactions with individuals. 

This Policy applies to website visitors, prospective and current clients, candidates and potential candidates, job applicants, references, sources, vendors, business partners, event participants, and other individuals whose personal information we process. It does not apply to information that is exempt from applicable privacy law or to information governed by a separate notice that expressly supersedes this Policy. 

This Policy is a notice of our practices. It is not intended to create contractual rights beyond those provided by applicable law.

2. Personal Information We Collect

Depending on your relationship with BoardWalk and how you interact with us, we may collect the following categories of personal information: 

Identifiers and contact information, such as name, postal address, email address, telephone number, online identifiers, account or profile identifiers, and similar contact details. 

Professional, employment, and education information, such as current and prior employers, job titles, responsibilities, work history, compensation information, qualifications, licenses, certifications, education, professional memberships, publications, board service, leadership experience, and career interests. 

Candidate and recruiting information, such as resumes or CVs, biographies, interview notes, assessments, references, source information, search preferences, relocation preferences, compensation expectations, availability, client feedback, candidacy status, and communications concerning potential opportunities. 

Client and business information, such as company, role, business contact details, search specifications, engagement information, transaction history, service preferences, and communications. 

Internet, device, and network activity, such as IP address, browser type, device identifiers, operating system, referring URLs, pages viewed, links clicked, session information, approximate location derived from IP address, and interactions with our website, emails, and advertisements. 

Commercial and engagement information, such as inquiries, services requested, event registrations, marketing preferences, and interaction history. 

Communications and content you provide, including information submitted through forms, email, telephone, video meetings, surveys, social media, or other channels. 

Inferences and assessments, such as professional interests, likely suitability for a position, leadership or role-related assessments, and preferences inferred from information available to us. 

Sensitive personal information, when relevant and permitted by law, such as government identifiers, account credentials, precise geolocation, racial or ethnic origin, religious or philosophical beliefs, union membership, sexual orientation, or other information treated as sensitive under applicable law. We do not use sensitive personal information to infer characteristics except as permitted by law. 

Other information you choose to provide or that we are permitted to collect under applicable law.

3. Sources of Personal Information

We may collect personal information from: 

You directly, including through forms, resumes, applications, interviews, communications, surveys, events, and meetings. 

Clients, prospective clients, candidates, references, sources, colleagues, employers, professional contacts, and other individuals or organizations. 

Publicly available sources, such as company websites, professional profiles, news articles, conference materials, government records, publications, and widely distributed media. 

Professional networking, recruiting, research, and data services, subject to their terms and applicable law. 

Our service providers, contractors, affiliates, and business partners. 

Cookies, pixels, web beacons, software development kits, analytics tools, advertising technologies, email tracking, server logs, and similar technologies. 

Information created or inferred by BoardWalk in connection with recruiting, client service, security, analytics, or business operations.

4. How We Use Personal Information

We may use personal information to: 

Provide, manage, improve, and personalize our services and website. 

Identify, evaluate, contact, and communicate with candidates and potential candidates regarding current or future opportunities. 

Conduct executive searches, candidate assessments, reference activities, client engagements, and related recruiting services. 

Communicate with clients, prospects, candidates, references, vendors, and business contacts. 

Process inquiries, requests, applications, registrations, and transactions. 

Maintain candidate, client, recruiting, and business relationship records. 

Conduct analytics, measure website and email performance, understand engagement, and improve our communications and services. 

Provide marketing, newsletters, event information, and other communications, subject to applicable choices and consent requirements. 

Advertise and measure the effectiveness of advertising, including through cookies, pixels, and similar technologies. 

Authenticate users, maintain security, prevent fraud or misuse, investigate incidents, and protect our rights and systems. 

Comply with law, legal process, professional obligations, contractual requirements, and lawful requests from authorities. 

Conduct due diligence, corporate transactions, audits, risk management, and internal administration. 

Create aggregated or deidentified information that is not reasonably capable of being associated with an individual, and use that information for lawful purposes. 

Carry out other purposes disclosed at the time of collection or with your consent.

5. Candidate, Applicant, and Recruiting Information

BoardWalk may collect information about individuals who are considered for client opportunities, who apply for employment with BoardWalk, or who are identified as potential candidates even if they have not directly submitted information to us. 

We may use and disclose recruiting information to evaluate qualifications and suitability; communicate about opportunities; present candidates to clients; arrange interviews; obtain and provide feedback; conduct reference, credential, or background-related activities where authorized and lawful; maintain records of current and future opportunities; improve our search processes; comply with legal obligations; and protect BoardWalk, our clients, candidates, and others. 

Candidate information may be disclosed to clients and prospective clients when reasonably related to an executive search or potential opportunity. We will seek appropriate authorization where required by law or our professional practices before making an identifiable candidate presentation. Information supplied by references or sources may be treated as confidential to the extent permitted by law. 

If BoardWalk uses automated tools or artificial intelligence to assist with research or summarization, such tools are intended to support (not replace) professional judgment. 

6. Cookies, Analytics, Advertising, and Online Tracking

We and third parties may use cookies, pixels, tags, web beacons, local storage, server logs, and similar technologies to operate the website, remember preferences, understand usage, measure communications, prevent fraud, improve services, and support advertising.

Third parties that provide analytics, advertising, embedded content, social-media features, email delivery, or similar services may collect information about your activity over time and across websites or online services. Their practices are governed by their own privacy notices. 

You may manage nonessential cookies through our cookie preference tool at  COOKIE SETTINGS. You may also adjust browser settings, although blocking some technologies may affect functionality. 

Do Not Track. Some browsers transmit “Do Not Track” signals. Because there is not a uniform industry standard for responding to those signals, our website may not respond to them. We do, however, process legally recognized opt-out preference signals, including Global Privacy Control, where required by applicable law. 

Global Privacy Control and California opt-outs. Where we engage in “sale” or “sharing” as defined by California law, we will treat a valid Global Privacy Control signal as a request to opt out for the browser or device from which the signal is sent. You may also exercise this choice through “YOUR PRIVACY CHOICES”.

7. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients for the purposes described in this Policy: 

Clients and prospective clients, including in connection with searches, candidate consideration, references, and service delivery. 

Service providers and contractors that perform services on our behalf, such as website hosting, cloud storage, IT support, cybersecurity, CRM, applicant tracking, recruiting technology, communications, analytics, advertising, event management, document management, professional research, and payment or administrative services. 

Advertising, analytics, and technology partners that help measure or deliver online content and advertising. 

Professional advisers, such as attorneys, accountants, auditors, insurers, and consultants. 

Affiliates, business partners, and other parties involved in providing or evaluating services or opportunities. 

Government authorities, law enforcement, courts, regulators, and other parties when required or permitted by law or when necessary to protect rights, safety, or security. 

Parties to a corporate transaction or potential transaction, such as a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets. 

Other parties at your direction, with your consent, or as disclosed at the time information is collected. 

We may disclose aggregated or deidentified information for lawful purposes. We do not attempt to reidentify information that we maintain as deidentified, except as permitted to test whether our deidentification processes are reasonable.

8. Sale and Sharing of Personal Information

California law defines “sale” and “sharing” broadly. “Sharing” includes making personal information available to a third party for cross-context behavioral advertising, whether or not money is exchanged. Because BoardWalk uses advertising or tracking technologies, certain disclosures of identifiers and internet or network activity to advertising or analytics partners may be considered a sale or sharing under California law. 

BoardWalk does not sell personal information for money. We may, however, sell or share the following categories within the meaning of California law: identifiers; internet or other electronic network activity; approximate geolocation; commercial or engagement information; and inferences associated with online activity. Recipients may include advertising, analytics, and technology partners. 

BoardWalk does not knowingly sell or share the personal information of consumers under 13 years of age. You may opt out through “YOUR PRIVACY CHOICES” or by using a recognized opt-out preference signal such as Global Privacy Control.

9. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, including to provide services, maintain candidate and client relationships, consider individuals for current and future opportunities, comply with legal and contractual obligations, resolve disputes, maintain security, and enforce agreements.  

Retention periods vary based on the nature and sensitivity of the information, the context in which it was collected, operational needs, applicable limitation periods, legal or regulatory requirements, and whether retention is necessary to protect rights or prevent fraud. BoardWalk maintains an internal records-retention schedule.  

Candidate information: Retained while you remain in our talent network, or as long as we have your consent or a legitimate interest to do so 

Client information: Retained for the duration of the business relationship plus applicable record-keeping periods 

Employment applications: Retained in accordance with employment law requirements 

Business records: Retained as necessary to show we have fulfilled obligations toward clients and candidates. 

 

Deletion and Anonymization 

When we no longer need Personal Data, we will remove it from our systems, securely delete or destroy it, or take steps to anonymize it so it can no longer be associated with you. In some cases, we may anonymize your Personal Data for research, marketing, or statistical purposes, in which case we may use this information indefinitely without further notice to you.

 10. Data Security

We use administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure. Safeguards may include access controls, authentication, vendor controls, security monitoring, encryption where appropriate, workforce training, incident response procedures, and secure disposal practices. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. Your Choices

Marketing communications: You may unsubscribe from promotional emails by using the unsubscribe link in the message or by contacting us. We may still send nonpromotional communications relating to an existing relationship, request, service, or legal obligation. 

Cookies and tracking: Use COOKIE SETTINGS, browser controls, Global Privacy Control, or “YOUR PRIVACY CHOICES”, as applicable. 

Updating information: You may contact us to request that we update or correct information, subject to verification and applicable law. 

Candidate communications: You may ask not to be contacted about future opportunities, although we may retain limited information necessary to honor that request.

12. U.S. State Privacy Rights

Depending on where you reside and subject to applicable law, you may have the right to request access to personal information; confirm whether we process personal information; obtain a portable copy; correct inaccuracies; delete personal information; opt out of sale, targeted advertising, or certain profiling; limit certain uses of sensitive personal information; and appeal a denial of a request. You may also have the right not to receive discriminatory treatment for exercising privacy rights.

We will verify requests using information reasonably related to your relationship with us. We will use information provided for verification only for verification, fraud prevention, security, or as otherwise permitted by law. We may deny or limit a request where permitted by law, including when we cannot verify identity, the request is excessive or manifestly unfounded, an exception applies, or fulfilling the request would adversely affect the rights of another person. 

Authorized agents may submit requests where permitted by law. We may require proof of authority and may ask the individual to verify identity or confirm the authorization directly. 

We generally respond within the time required by applicable law. 

13. California Privacy Notice

This section supplements the remainder of this Policy and applies to California residents where BoardWalk is subject to the California Consumer Privacy Act, as amended (CCPA). Terms defined in the CCPA have the same meaning in this section.

California Sources and Purposes 

The categories of sources and purposes are described in Sections 3 and 4. We collect, use, retain, and disclose personal information only as reasonably necessary and proportionate to the disclosed purposes, compatible purposes, or other purposes permitted by law.

BoardWalk does not use or disclose sensitive personal information for purposes that require a “Limit the Use of My Sensitive Personal Information” link unless otherwise stated at collection.  

California residents may exercise rights using the methods in Section 12. Requests to opt out of sale or sharing do not require identity verification, although we may request information necessary to process the request. A valid Global Privacy Control signal will be treated as an opt-out request where required. 

California Notice of Financial Incentives 

BoardWalk does not currently offer a financial incentive or price or service difference in exchange for the collection, retention, sale, or sharing of personal information. If that changes, we will provide the notice and obtain the consent required by law. 

California “Shine the Light” 

California Civil Code section 1798.83 may permit California residents to request information concerning disclosure of certain personal information to third parties for their direct marketing purposes. BoardWalk does not disclose personal information to third parties for their own direct marketing purposes as contemplated by that law without providing legally required choices. Requests may be directed to the contact information in Section 18. 

14. Automated Decision-making and Profiling

BoardWalk may use technology to assist with sourcing, matching, analytics, or administrative tasks. We do not intend to make decisions that produce legal or similarly significant effects solely through automated processing without meaningful human involvement unless we provide any notice, access, explanation, opt-out, or other rights required by applicable law.  

15. Children’s Privacy

Our website and services are intended for adults and are not directed to children under 18. We do not knowingly collect personal information from children under 18. If we learn that we collected such information, we will take reasonable steps to delete it. We do not knowingly sell or share the personal information of individuals under 16. 

16. International Data Transfers

BoardWalk is based in the United States. Personal information may be processed and stored in the United States or other jurisdictions where BoardWalk or its service providers operate. Those jurisdictions may have privacy laws that differ from the laws where you reside. Where required, we use appropriate safeguards for cross-border transfers. 

17. Third-Party Websites and Services

Our website or communications may link to third-party websites, platforms, or services. BoardWalk does not control those third parties and is not responsible for their privacy, security, or content. Review their privacy notices before providing personal information. 

18. Changes to This Policy

We may update this Policy to reflect changes in our practices, technology, services, or legal obligations. We will post the revised Policy and update the “Last Updated” date. Where required, we will provide additional notice or obtain consent. We review this Policy at least annually and when material practices change.
